General terms and conditions

1. Scope and contracting party
These general terms and conditions apply to all orders placed through the online shop www.noelcarservice.ch/shop, in the version valid at the time of the order.

2. Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
By submitting an order, the customer makes a binding offer to conclude a purchase contract. The contract is concluded once we confirm the order by e-mail.
The ordering process comprises the following steps: selection of products, review of the shopping cart, entry of delivery and billing details, choice of payment method, verification of the information and binding submission of the order.
Before binding submission, all entries can be corrected or the process cancelled at any time.
3. Prices and VAT
All prices are in Swiss francs (CHF) and include VAT at 8.1 %. Shipping costs are shown separately in the shopping cart.
4. Shipping and delivery
We deliver exclusively within Switzerland and the Principality of Liechtenstein.
Shipping costs are a flat CHF 12.50 per order. For bulky items, marked as such, they amount to CHF 20.50. Shipping is charged once per order, regardless of the number of items.
Part of our range is shipped directly from our suppliers‘ warehouses. In these cases the delivery time is usually 10 to 25 working days. The expected delivery time is stated on each product page. Stated delivery times are indicative and not fixed dates.
Risk passes to the customer upon handover of the goods.
5. Payment
The following payment methods are available: credit and debit cards, TWINT, Apple Pay, Google Pay and advance payment by bank transfer. The methods displayed during the ordering process are authoritative.
In the case of advance payment, goods are shipped once payment has been received.
6. Retention of title
The goods remain our property until payment has been made in full.
7. Right of return
Swiss law provides no statutory right of withdrawal for online orders. We voluntarily grant our customers a right of return of 14 days from receipt of the goods.
The goods must be returned unused, complete and in their original packaging. Please announce the return in advance by e-mail to info@noelcarservice.ch.
Return shipping costs are borne by you. Once we have received and inspected the goods, we will refund the purchase price within 14 days using the same payment method. The original shipping costs are not refunded.
8. Notice of defects and warranty
The statutory provisions of the Swiss Code of Obligations apply (Art. 197 et seq. CO).
Obvious defects and transport damage must be reported to us in writing within 7 days of receipt of the goods. In the case of a justified notice of defects, we will supply a replacement or refund the purchase price.
9. Installation and use
Wall mounts and storage systems must be installed properly and only on load-bearing walls. The stated load capacities must not be exceeded. Fixing material must be matched to the substrate.
Before installing in a rented property, check whether drilling into walls is permitted and observe any fire-safety and tenancy regulations applicable to the storage of tyres in communal garages and cellars. No liability is accepted for damage resulting from improper installation or use.

12. Applicable law and place of jurisdiction
Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zug, Switzerland.
13. Contract language
The contract language is German.
